What is an Apostille?
Since October 15, 1981 the U.S. has been part of the Hague Convention that provides for a certification of the Public Documents, including birth, marriage, and death records, to be used in countries, such as Italy, that are a part of the Convention.
The sole function of the Apostille is to certify the authenticity of the signature on the document, the capacity in which the person signing the document acted, and the identity of any stamp or seal affixed to the document. The Apostille is prepared by the office of the Secretary of State in which the document was issued.
Which U.S. Documents need to receive the Apostille for my Italian Citizenship?
U.S. birth/marriage/death certificates of the Italian ancestor, his or her direct descendants, and the birth, and marriage records of the applicant must be authenticated with the Apostille. If you are divorced, you must have both the previous marriage certificate and divorce certificate authenticated with the Apostille. If you have children under the legal age (under 18) you must also submit certified copies of birth certificates, legalized with the Apostille of the Secretary of State.
How do I get an Apostille?
First, when you obtain the U.S. Vital Records for your Italian Citizenship Application, make sure that the Vital Records Office of the State/County of issuance understands that the documents will be legalized with the Apostille. Some State's have certain requirements for preparing documents that will be subsequently authenticated with the Apostille. Then you must contact the Secretary of State in which the document was issued to find out the address, cost, and procedures for getting the Apostille.
